inthepearl.com has unique terms and conditions specific to the type of user entering into the agreement. The definitions of users on the site can be found below. The following terms and conditions are applicable to registered personal, non-business, non commercial users.

Non-registered user: users of inthepearl.com who choose to navigate, browse, read, and or use the site in a read-only fashion without registering for an inthepearl.com account. This type of user will not have the ability to create any content of any kind on inthepearl.com

Registered personal account: users of inthepearl.com who choose to register for a personal account for non-commercial, non-business use. A registered personal account enables users to add content to inthepearl.com. Content can be defined as creating business reviews, commenting on business reviews, event creation, creation and updating a personal account profile

Personal user account

Eligibility for use: Many features of inthepearl.com such as, but not limited to: user public profile creation, review creation, comments, event creation require a personal registered user account.

Personal Account: A personal account is a type of registered user account and is for personal, non-commercial/business use. Any misuse of the account will result in termination. inthepearl.com may terminate any account, at any time, and for any or no reason.

Security of content: inthepearl.com does not guarantee and is not responsible for privacy of registered user content except as set forth in the inthepearl.com privacy statement.

You agree that when creating a personal registered user account you will not:

1. Give inaccurate information about yourself
2. Impersonate anyone
3. Create an account for anyone other than yourself
4. Create or maintain multiple accounts

As a personal registered user account holder you agree not to:

1. Use the site for any kind of illegal activity such as but not limited to:
1. Stalking
2. Spam
3. Pornography

Termination: You agree that inthepearl.com reserves the right to terminate a personal account for any or no reason, and at any time without notice.

Content

inthepearl.com content is defined as: registered user created reviews, comments, images, events, or any other type of content posted to the website which can be seen live by the public.

You agree that your posted content will not:

1. Contain content which is illegal and or violates any law within the United States of America
2. Represent the account holder as a representative or employee of the business in question or any other business
3. Be authored a result of any kind of barter, trade or compensation from a businesses
4. Be offensive
5. Harmful
6. Abusive
7. Contain expletives or profanities
8. Contain personal or private information such as email addresses, phone numbers, or physical street addresses
9. Contain personal attacks
10. Be Harassing in nature
11. Contain sexual references
12. Accusatory of illegal activities
13. Content which is not applicable to the author’s specific experience at the business the review is being written for
14. Violate third party rights, including but not limited to right of privacy, copyrights, trademarks, patents, trade secrets or any other intellectual property rights

You agree that inthepearl.com administrators have the right to reject any content, at any time, for any reason or no reason at all.

Permission for use of content: As a registered personal account holder you agree that inthepearl.com may use your content many different ways including, but not limited to displaying it on different pages within inthepearl.com, physical marketing and advertising components, digital marketing and advertising components. You agree that inthepearl.com may use your content for any purpose, at any time, for any or no reason and without notice. You agree that inthepearl.com may also use your content if you choose to close your account. Lastly, you agree to waive all claims, assertions and or rights to your content.

Events

Registered, non-business, no commercial users of inthepearl.com may create event postings to promote and advertise their events under the following conditions and restrictions:

1. Event must not be illegal in nature
2. Event must take place less than 3 months from the posting date

inthepearl.com has no association with any events created or promoted on the inthepearl.com website Furthermore, inthepearl.com holds no liability for those planning to or physically attending events promoted on the website. Users of inthpearl.com agree to release complete and 100% liability to inthepearl.com for any bodily injury, death or financial injury which may occur at any event posted or promoted on inthepearl.com.

Site availability and performance

inthepearl.com reserves the right to modify, update, limit availability and or discontinue the site at our sole discretion, at any time, for any or no reason, and without notice or liability. Inthpearl.com makes no guarantee of uptime or downtime of the site.

inthepearl.com provides consumers with opportunities to purchase products and services from third party businesses ("businesses") with a time limited promotional added value (a "Deal"). Businesses are willing to offer attractive promotions in order to reach the NW Portland Community.

1. How It Works.
   By placing an order for a given Deal, you make an offer to purchase the Deal you have selected on the terms, restrictions and conditions associated with the Deal. Once you’ve placed your order, you will receive a confirmation of the Deal via your account email address and your credit card will be charged for the amount of the Deal. We will notify you by email when the coupon (defined below) for the Deal is ready to be used. You are required to create an account in order to purchase any Deal. An account is required so we can collect information to allow you to pay for your Deals and provide you with easy access to print your Deals, view your past purchases, and modify your preferences.
2. How It Works.
   The expiration date for a Coupon is as printed on the Coupon.
   
   If the expiration of the paid value of the Coupon as of the date printed on the Coupon is prohibited under the law of the jurisdiction in which the Business is located, then the Coupon shall expire as follows: the promotional portion of the Coupon will expire on the date printed on the Coupon, and the paid portion of the Coupon will expire five (5) years from the date the Coupon is issued, except to the extent applicable law requires that the Business extend the period in which the Coupon may be redeemed. The Business is obligated to honor the Coupon in compliance with law. If the Business refuses to honor the Coupon before the legally permitted expiration date, then Inthepearl.com will refund the paid portion of your Coupon in the form of a credit for future inthepearl.com Deals. In order to receive the credit, you must provide the following information in writing to admin@inthepearl.com: (a) identification of the Coupon and Business with whom you sought to redeem the Coupon, (b) statement of the date, time, and circumstances in which the business refused to redeem the Coupon, and (c) a statement, under penalty of perjury, that the Coupon has never been redeemed with the Business.
3. Deal specific terms
   Each Deal has specific terms associated with the Deal, which will be presented to you at the time you commit to purchase the particular Deal. Deal specific terms supersede any inconsistent terms in this Agreement, except to the extent such terms are prohibited by applicable law.
4. Deal specific terms
   Unless otherwise stated in the Coupon or required by law, the following additional terms apply to all Coupons:
   
   
   • no cash value for any Coupon,
   • no cash back will be issued for partial redemption of the paid portion of a Coupon, except as required by law,
   • no cash back or credit will be issued for partial redemption of the promotional portion of a Coupon,
   • use of a Coupon for alcoholic beverages is at the sole discretion of the Business (which may be limited by applicable state or provincial law), unless otherwise noted on the Coupon,
   • Coupons cannot be combined with any other coupons or promotions unless otherwise noted in the Coupon,
   • Coupons cannot be used for taxes, tips, prior balances, shipping or handling, as applicable,
   • neither Inthepearl.com nor the Business is responsible for lost or stolen Coupons or Coupon reference numbers,
   • duplicate use, sale or trade of a Coupon is prohibited, except as required by law,
   • unless otherwise stated at the time a Coupon is purchased, the Coupon price does not include sales, value added or use taxes, which may be charged to you separately by the Business at the time you redeem the Coupon.
5. Business Responsibility
   To be clear, Inthepearl.com markets the Deals and acts an as agent in selling the Coupons on behalf of the Businesses. But the Business is the issuer of the Coupon. As issuer of the Coupon, the Business shall be fully responsible for any and all injuries, illnesses, damages, claims, liabilities and costs suffered by or in respect of a customer, caused in whole or in part by the Business or its products and services, as well as for any unclaimed property liability arising from unredeemed or partially redeemed Coupons. By purchasing a Deal, a customer acquires the right to print a Coupon issued by the participating Business and to use the Coupon according to its terms and the terms of this Agreement. Whether you choose to print and/or redeem the Coupon is within your sole control and at your sole discretion.
6. Promotions of the Deal Program
   From time to time we may offer special promotions, contests and/or sweepstakes intended to provide you an incentive to purchase Deals or to encourage you to get others to do so. The applicable rules will be posted on the Site in or near the description of each such promotion. We reserve the right to interpret these rules in our sole discretion, and you hereby agree to our interpretation.
7. Products Available for Sale
   The Site can be accessed from countries around the world. You understand that some or all products or services provided on the Site may not be available for purchase to persons residing in certain jurisdictions or geographic areas. Inthepearl.com reserves the right, in its sole discretion, to exclude or otherwise limit the provision of a Coupon for any product or service to a person residing in any jurisdiction or geographical area. Inthepearl.com does not represent or warrant that any product or service promoted on the Site will be available for purchase by any particular person.
8. Refunds
   inthepearl.com will provide a refund of the purchase price paid by you for any Deal within five days after the purchase of a Coupon, provided that the Coupon has not yet been redeemed. After five days, we do not provide refunds except that we will provide a refund if you are unable to redeem a Coupon before the applicable expiration of the Coupon because the relevant Business has gone out of business.
9. Playing Nicely
   Some of the Deals are provided for a limited number of purchasers or a limited number of purchases, as specified for the particular Deal. Any attempt by a purchaser to obtain more than the permitted number of Coupons specified for a particular Deal by using multiple or different identities, credit cards, forms, registrations, addresses or any other method will void that person's purchases. Inthepearl.com will be the arbiter, in its discretion, as to whether purchase characteristics indicate a violation of these rules.
